Terms of Service

These Terms of Service ("Terms") govern your access to and use of ClaimsOpsHQ (the "Service"), operated by Fortress Claims Consulting ("we", "us", "our"). By creating an account or using the Service you agree to these Terms.
1. Eligibility & Accounts
The Service is provided to authorized employees, contractors, and clients of Fortress Claims Consulting and to firms that have signed a separate subscription agreement with us. You must be 18 or older and able to enter a binding contract. You are responsible for safeguarding your credentials and for activity that occurs under your account.
2. Acceptable Use
- Do not upload content you do not have the right to use, or content that violates the privacy or intellectual property rights of others.
- Do not attempt to probe, scan, or breach the security of the Service or interfere with other users.
- Do not use the Service to send spam, phishing, or unsolicited bulk communications.
- Do not use the Service to engage in unauthorized practice of law, public adjusting, or insurance activity outside the jurisdictions in which you are licensed.
3. Customer Data
You and your firm retain all rights in the claims data, documents, and communications you submit to the Service ("Customer Data"). You grant us a limited license to host, process, and display Customer Data solely to operate, secure, and improve the Service for you. We handle Customer Data in accordance with our Privacy Policy.
4. AI Features
The Service uses third-party AI models to summarize, classify, extract, and draft content. AI output may be inaccurate or incomplete. You are responsible for reviewing AI output before relying on it for any regulated activity, including coverage interpretation, deadline calculation, or correspondence with carriers and clients.
5. Subscriptions, Trials & Fees
Paid plans are billed in advance on a monthly or annual basis. Free trials convert to a paid subscription at the end of the trial unless cancelled. Fees are non-refundable except where required by law. We may change pricing for future billing periods with at least 30 days' notice.
6. Confidentiality & Security
We treat Customer Data as confidential and apply administrative, technical, and physical safeguards designed to protect it, including TLS in transit, encryption at rest, and row-level access controls. No system is perfectly secure; you are responsible for maintaining device-level security and for promptly notifying us of any suspected unauthorized access.
7. Service Availability
We work to keep the Service available but do not guarantee uninterrupted access. Scheduled maintenance, third-party outages, or events outside our reasonable control may cause downtime. We may modify, suspend, or discontinue features at any time.
8. Termination
You may cancel your subscription at any time from Settings. We may suspend or terminate accounts that violate these Terms, that are used for unlawful activity, or for non-payment. Upon termination you may export Customer Data for 30 days, after which it may be deleted from active systems in accordance with the Privacy Policy.
9. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. CLAIMSOPSHQ IS NOT A LAW FIRM, AN INSURANCE CARRIER, OR A LICENSED PUBLIC ADJUSTER, AND DOES NOT PROVIDE LEGAL OR INSURANCE ADVICE.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEITHER PARTY WILL BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST REVENUES, OR LOST DATA. OUR AGGREGATE LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS WILL NOT EXCEED THE FEES YOU PAID FOR THE SERVICE IN THE TWELVE MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
11. Indemnification
You will defend, indemnify, and hold us harmless from claims arising out of your Customer Data, your use of the Service in violation of these Terms, or your violation of any law or third-party right.
12. Governing Law
These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws rules. Exclusive jurisdiction and venue lie in the state and federal courts located in Travis County, Texas.
13. Changes to the Terms
We may update these Terms from time to time. Material changes will be announced inside the app before they take effect. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
